They do not affect your statutory rights.  The terms and conditions as given apply to information contained in the pages of www.Millmark.co.uk, ( i.e., `the Millmark Website`) and to the ordering of any products from this website. By placing an order, or using this Site, you (`the buyer`) agree to and accept our Terms and Conditions. The Site is provided to you free of charge for your personal use subject to these Terms and Conditions. All transactions undertaken through this website are governed by English Law. 4. Satisfaction Guarantee

 At Millmark, we endeavour to keep the quality assured products, at competitive prices and always aim to guarantee your total satisfaction. We hope you will be happy with your purchase and we encourage constructive feedback on its usage or our service to you. We honour all requirements of UK Consumer Protection law and without affecting your statutory rights as a consumer we will replace or refund the price of any products which we consider unsatisfactory. If at any time you are unhappy with our dealings, we aim to resolve any issues as quickly and amicably as possible. If there are any problems with the delivery or the products, please contact us. We will endeavour to be helpful and address any problems fairly and professionally.

If you change your mind about your order you have up to 14 days, from receipt, during which you can return the items, at your expense and provided that they are in their original condition, for a full refund on the products you ordered. Charges for postage will not be refunded. If there is nothing wrong with the products and you received them free of delivery charge, postage costs will be deducted from your refund.

 

5. Orders, Shipping and Deliveries

 It is our aim to offer a fast and reliable delivery service, using the method specified in the checkout procedure. The cost of your delivery is automatically calculated according to the final amount of the order.

1. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the "confirm order" button on the ‘check out’ page. 

2.All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.  3. After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note this email is an acknowledgement and is not an acceptance of your order.  4. For certain goods, information concerning stock availability is not available on the Website. If you order goods which are not available from stock, we will contact you by e-mail and you will have the option to wait until the goods are available from stock, or cancel your order in accordance with our cancellation and returns policy.  5. We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Your payment of the price for the goods represents an offer on your part to purchase the goods. Acceptance of your order and the formation of a contract between us will take place when we send you an email confirming that the goods you have ordered have been despatched to you unless we have notified you that we do not accept your order or you have cancelled it in accordance with our cancellation and returns policy . 

6. Accuracy of content: We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions and capacities given about the goods are approximate only.

 

7.  All orders received by us are shipped subject to availability. If the goods you have ordered are not available from stock or will not be readily available from suppliers within 7 working days of your order, we will contact you by email or phone (if you have given us the details). We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when our shipper delivers.

 

8. Our company policy is to try to dispatch all orders within 48 hours or 2 working days. If items are unavailable then we will contact you to advise those that are not in stock and those, which can be sent immediately. Obviously, we cannot be held responsible for delays in the postal services. It is best to allow up to 5 working days for delivery. Other Important Information When it is not possible to deliver the package, it will be held at your local Royal Mail office for 5 days before being returned to us. It is your responsibility to contact your local sorting office to arrange re-delivery or collection. We want you to be completely satisfied with the products and service that we offer. If there are any problems with the delivery or the products, please contact us. We will endeavour to be helpful and address any problems fairly and professionally.

It is advised you check your local sorting office before contacting us if delivery has taken more than a week. Refunding or resending depends on the period that the Royal Mail regards postage as officially lost (i.e .17days).

  For deliveries within England, Scotland and the Channel Islands our standard charges are as follows: Order Value: 0 - £29.99, Delivery Charge - £3 Order Value: Over £30..00, Delivery Charge – FREE

If a customer requires a next day or recorded delivery service then additional charges may apply.

Delivery and Risk1. We despatch items ordered by you as they are available using either Royal Mail postage or a courier service depending on the size of the order. The delivery charge is as set out in the Order Confirmation section of the Website where applicable. We aim to deliver your items in the shortest time possible. This is normally within 7 days of receiving your order. You will be contacted at the earliest possible time should this be extended due to supply problems. 2. We are able to deliver items to UK Mainland. Orders will be sent to the delivery address that you have elected either when registering on the Website or when amended during the Delivery Confirmation section whilst ordering. We cannot be held responsible if this delivery address is incorrect. If you wish to change the delivery address prior to submitting your order you may do so by entering the new details in the Checkout section. If you wish to change your delivery address and an order is "IN PROGRESS" you must contact the Customer Services team.  3. We will use our reasonable endeavours to ensure that the estimated delivery times set out in the deliveries section are met but we cannot accept any liability for late deliveries which are due to circumstances outside of our reasonable control.  4. On occasion items may be lost in transit. If this occurs, you must follow the instructions set out in the deliveries section.  5. Once the goods have been received by you, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us. 

Satisfaction Guarantee If you are not fully satisfied with any of the products that you have purchased from Millmark Foods website then you must return the item(s) (see Returns &Refunds below ) and inform us in writing or email of your reasons for not being satisfied with the product. If required Millmark Foods will contact the manufacturers on your behalf and deal with your complaint as quickly and efficiently as possible, and will keep you informed of our progress. Millmark Foods will replace any items damaged upon delivery but may request that the damaged items be returned to us prior to issuing the replacement. You may also be asked to complete a Lost Parcel or Damaged Items declaration form before a replacement can be issued.

Millmark welcomes your comments and suggestions on our service as we aim to provide our customers with the best possible service at all times. If you have any complaints then contact us by phone or email.

6. Overseas Deliveries

It is not our present policy to accept overseas orders and any orders dispatched overseas will be a special ‘one-off’ agreement.

7. Secure Ordering

 We use Sage as our "gateway" to collect all credit card details. They use SSL (Secure Socket Layer technology) to accept your payment details. The padlock symbol is displayed at the bottom of the screen. Millmark does not have access to your credit card number since this is sent directly to Sage They provide secure online credit card and debit card payment solutions for thousands of online and mail order businesses. Sage has achieved the highest level of compliance under the Payment Card Industry Data Security Standard (PCI). They adhere to the most stringent levels of fraud screening, ensuring that customer's details remain secure throughout the transaction process.

8. Returns and Refunds

We abide by the safely Distance Selling Regulations and you can find out more about your rights at http://www.which.co.uk/advice/shop- -online/index.jsp  

  1. If you have any complaint, you should return the goods to us post-paid, with a certificate of posting to guarantee validity. If the claim is supported then we will refund the standard postage costs and replace either the product or refund the price as we think most appropriate. Do telephone or email us first to discuss the matter. We want to retain the human service. If you do receive damaged goods, please retain all relevant documentation in case a claim needs to be made against the carrier.
  1. In the case of damage in transit, we are not liable for any breakages, which occur once goods have left our premises.
  2. You may return any product you buy from us without any fuss for full refund in accordance with our 14-day exchange. We will not refund the cost of postage. Please note: we may charge a 10% restocking charge. In the case that the goods were originally despatched without charge for postage then a reduction will be applied to the refund for that postal cost.
  3. If you decide you do not want the goods you need to inform us in writing within 14 days of delivery or by fax or email. A telephone call is not enough.  The guarantee is only valid if the product has not been opened or tampered with and providing proof of purchase is enclosed.

9.Promotional Offers

Certain promotional offers may only be available for a limited period and while stocks last. If your order is received after the offer period, or if the goods are no longer available under that particular offer we will notify you before we dispatch the goods. Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.

10. The Price, Payment and Description

The price of the products will be the price quoted in the web site at the time we accept your order. The price will include any relevant value added tax, and in addition to the price, you will have to pay our delivery charges as quoted in our terms and conditions at the time we accept your order - unless you qualify for free delivery. All cheques and postal orders must be in UK Pounds and made payable to Millmark Foods.

In the event that a product is listed at an incorrect price or described incorrectly because of a typographical  error, or error by our suppliers, we reserve the right to cancel any orders placed whether or not the order has been confirmed and payment charged. In such a case, if you no longer wish the product, we will issue a refund immediately.  We reserve the right to alter our prices in accordance with fluctuations in market forces

Expiry Date on Payment Card: Please ensure that the expiry date of your payment card is after the day that you place your order. Payment is taken at the point of ordering the goods and in the event that the payment card has expired we will be unable to take payment and fulfill your order.  Methods of Payment: If you choose not to purchase online, there are a number of other options:

As part of our policy of continuous review, these terms and conditions are subject to change at any time without prior notice and at the discretion of Millmark.co.uk. At no point do they affect your statutory rights. Any amendments will immediately apply to the use of the site. 

13.Privacy Notice

We place a high priority on your privacy and will only use information collected from you in accordance with the Data Protection Act 1998. We will use that information only to process your order and provide you with the best possible service.

As part of our ongoing service we may contact you by e-mail or telephone to ensure that you are completely satisfied with both your purchase and our service. If you would prefer us not to do this then please e-mail us and we will remove your name from our database. We will establish if you are willing to receive information periodically on our products and services.

This information will be held by us securely in accordance with current legal requirements and consists of your name, address, telephone number, email address. In accordance with the Privacy and Electronic Communications Act passed into law 11th December, 2003, we do not send random marketing emails to personal email addresses (spam). All orders places with us are processed through a Secure Server Layer that encrypts all information before it is transferred from your P.C. Credit Card Security: All credit card numbers are encrypted in the software when the order is place. Credit Card numbers are only decrypted after they reach our computer. They are not held in clear text on any web site.

Password and security When you register to use the Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible the integrity, and any necessary updates, to your personal details, and for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately.

If Millmark Foods has reason to believe that there is likely to be a breach of security or misuse of the Site, we may require you to change your password or we may suspend your account.

14.Limitations You may not use the Site for any of the following purposes: a) disseminating or transmitting  any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice, or infringes access to other computer systems; b) making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner. Millmark reserves the right to refuse to post material on the Site or to remove material already posted on the Site.

Our website design, layout, content or text cannot be copied, edited or otherwise manipulated without our express written permission. This includes not placing the website within the frame-set of another site or creating a “deep link” to pages within our website or similar activities. 

We will all reasonable care to ensure that availability of this website will be uninterrupted but this cannot be guaranteed. Access to the website may also be occasionally restricted to allow for maintenance, or the introduction of updates. We will try to ensure that this site is free from viruses or defects.  Except in case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website. 

You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the Home page of MillmarkHealth.co.uk as long as the link does not undermine Millmark, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. 

The foregoing paragraphs, sub-paragraphs and clauses of these Terms & Conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses. Millmark will not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute. 

Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract. 

15.Reward Points

The reward Points scheme does not apply to the fees paid for services from the health clinic, nor to any Vouchers purchased for services or goods.

16 Law

These Terms and Conditions of Sale shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.

Events beyond our reasonable control : We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

Waiver & Invalidity :If you breach these terms and conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions. If any part of these terms and conditions is unenforceable (including any provision in which we exclude are liability to you) the enforceability of any other part of these conditions will not be affected.
